A provisional patent application form collects identifying information; it does not replace the invention disclosure. For a U.S. filing, first prepare the current cover sheet or equivalent identifying information. Then add the written description, necessary drawings and applicable fee. This guide helps separate administrative fields from technical material.
Where to Find the Official Provisional Cover Sheet
Start with the USPTO provisional application guide, which links the cover-sheet instructions and requirements. Use the current official version rather than an old third-party download. Finally, confirm that your submission clearly identifies the filing as provisional.
Information to Prepare for the Form
Verify the invention title, actual inventor names, relevant residences and correspondence details, and any other identifying information required by the official instructions. Also, review any government-interest information where applicable. As a result, names and titles should match throughout the complete submission.
Create a preparation worksheet with columns for field, proposed entry, source of information, reviewer and unresolved question. Next, have the responsible person verify each entry. Do not guess inventorship or ownership from a company contact list.
The Disclosure Is a Separate Part of the Package
Prepare a description explaining how to make and use the invention, with necessary drawings. For example, include relevant components or steps, their relationships, variations and examples. An administrative cover sheet or a short product description cannot establish that the intended subject matter is adequately disclosed.
A provisional application does not require formal patent claims or an inventor’s oath or declaration. However, that does not make disclosure quality optional. A later claim receives the earlier benefit only to the extent the provisional supports it. Also, you cannot use a provisional application for a design invention.
Check the Fee and Online Submission
Confirm fee eligibility against the current USPTO schedule. Next, in Patent Center, check the application type, bibliographic entries, document designations and final files before submitting. After submission, keep a complete copy of the received package and receipt.
Form-to-Filing Review Checklist
Reconcile the approved title and inventor information, disclosure, figures, identifying papers, fee and file versions. Then assign responsibility for checking the filed record and monitoring correspondence. Finally, record the next-filing plan. You generally must file a corresponding nonprovisional within 12 months to claim the provisional benefit.
